Trust-Rails is not a bank, custodian, broker-dealer, investment adviser, or fiduciary. Trust-Rails does not hold, manage, or have custody of any retirement funds or participant assets at any time during the transfer process.
Trust-Rails and its owners, affiliates, and their employees (collectively, “Trust-Rails”) makes no recommendations regarding your retirement account, including, but not limited to, whether you should rollover your retirement account or on the investment of that account. Trust-Rails is not providing, or agreeing to provide, any services or advice in a fiduciary or advisory capacity under the Employee Retirement Income Security Act (“ERISA”), Section 4975 of the Internal Revenue Code, or any other federal or state law.
Trust-Rails does not act as a “fiduciary” as defined in ERISA Section 3(21) or the Department of Labor's fiduciary rule. Our platform is a technology service that enables the electronic transfer of retirement assets between custodians at the direction of participants and plan sponsors.
Nothing on this platform, including any content, tools, calculators, or communications, constitutes investment advice, tax advice, legal advice, or a recommendation to take any particular action with respect to your retirement account. You should not rely on information or services provided by Trust-Rails as a basis for your rollover or investment decisions.

The decision to roll over retirement assets is solely the responsibility of the account holder. Participants should consider factors including, but not limited to: investment options, fees and expenses, services available, penalty-free withdrawals, protection from creditors, required minimum distributions, employer stock considerations, and any other factors relevant to their individual circumstances.
By using Trust-Rails, you acknowledge that you are directing the transfer of your own retirement assets and that Trust-Rails is acting solely as a technology facilitator at your direction.
The availability of any custodian, plan, or service provider on the Trust-Rails platform does not constitute an endorsement, recommendation, or preferential treatment of that entity. Trust-Rails does not evaluate, rate, or rank custodians or their services for suitability to any particular participant.
Trust-Rails does not charge participants directly for the use of its platform. Platform fees are paid by participating custodians and plan service providers. However, your sending or receiving custodian may charge their own fees in connection with a rollover transaction. Please consult your custodian's fee schedule for details.
Trust-Rails is not registered as a broker-dealer with the Securities and Exchange Commission (SEC) or the Financial Industry Regulatory Authority (FINRA). Trust-Rails is not registered as an investment adviser with the SEC or any state securities regulator. Trust-Rails is not a bank or trust company and is not licensed or regulated as such.
Trust-Rails maintains SOC 2 Type II compliance for the security, availability, and confidentiality of participant data processed through our platform.
